These are the required elements/files:

Micro-entity declaration (if applicable) fee – You will need to pay the required filing fee for your design patent application. The fee structure can vary, so it is necessary to check the USPTO website for the latest fee information.

Application Data Sheet  (ADS)  – This is the formal application form that provides information about the applicant, inventors, and the name of the design being patented.

Specification – A written description of the design that explains its features and any specific details that are unclear from the drawings. While this is not as extensive as the specification for a utility patent, it should be sufficient to enable a person skilled in the art to understand the design based on the drawings.

Claims – A design patent application may contain only one claim.

Drawings or Photographs – The most critical component of a design patent application is a visual representation of the design. This typically involves drawings or photographs that clearly show all views and details of the design. The drawings or photographs must meet specific USPTO requirements regarding size, format, and clarity.

Oath or Declaration – A declaration or affidavit identifying the inventor and acknowledging that the applicant is the true and original inventor of the design. This document may be submitted separately or included with the application.

Priority declaration (if applicable) – If you have filed a foreign application for the same design and wish to claim priority, you may need to include a priority declaration.
